What is an industrial safety declaration?

The declaration of industrial Safety of a hazardous production facility (hereinafter referred to as the declaration) is developed for projected, operating hazardous production facilities and should characterize the danger of industrial production at the stages of their commissioning, operation and decommissioning.

Industrial Safety Declaration of a hazardous production facility is a document that presents the results of a comprehensive assessment of the risk of an accident, incident, and analysis of the adequacy of measures taken to prevent accidents and ensure the organization‘s readiness to operate a hazardous production facility in accordance with the requirements of industrial safety standards and regulations, to localize and eliminate the consequences of an accident at a hazardous production facility.

The Law of the Republic of Kazakhstan No. 188 “On Industrial safety at hazardous production facilities“, Article 76. Mandatory declaration of industrial safety of a hazardous production facility.

     1. Hazardous production facilities that meet the criteria for classifying hazardous production facilities as declared, approved by the authorized body in the field of industrial safety, are subject to mandatory declaration of industrial safety.

     2. The Declaration of Industrial Safety of a Hazardous production facility (hereinafter referred to as the declaration) is developed for planned and operating hazardous production facilities.

     3. The declaration is developed independently by the organization operating the hazardous production facility.

     4. The declaration is approved by the head of the organization operating the hazardous production facility.

The head of an organization operating a hazardous production facility is responsible for the timely submission, completeness and reliability of the information contained in the declaration, as established by the laws of the Republic of Kazakhstan.

     6. The examination of documents for the assignment of the registration code of the declaration is carried out by the authorized body in the field of industrial safety.

The authorized body in the field of industrial safety, having reviewed the submitted documents, decides on the registration of the declaration or submits a reasoned refusal.

The declaration registered by the authorized body in the field of industrial safety is stored in the authorized body in the field of industrial safety in the form of an electronic document.

     7. The operation of a hazardous production facility without a declaration registered by the authorized body in the field of industrial safety is prohibited.

     8. Information about hazardous production facilities for which industrial safety declarations are registered is posted on the Internet resource of the authorized body in the field of industrial safety.

     9. In case of changes in conditions affecting industrial safety, including cases of modernization or redesign of a hazardous production facility, the declaration is subject to change.

If changes are made to the declaration, it must be re–registered no later than three months after the changes are made.
